In-Person Membership Terms and Conditions

Please read these Terms of Use (“Terms”, “Terms of Use”) carefully before using the website (the “Service”) operated by Fulton Fit Academy (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Intellectual Property

The Service and its original content, features and functionality are and will remain the exclusive property of Fulton Fit Academy and its licensors.

Links To Other Web Sites

Our Service may contain links to third-party web sites or services that are not owned or controlled by Fulton Fit Academy.

Fulton Fit Academy has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Fulton Fit Academy shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.


We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Membership Policy

When signing up for the Fulton Fit Academy you are agreeing to our 3-month commitment meaning you can cancel anytime after your three-month period is up from the day of your first payment.

You are not able to cancel your membership in the middle of the month. The weekly, biweekly, or monthly payments are merely payment plans to make your payments easier. You must abide by our 30-day cancellation policy which can be viewed in the next section.

If you are leaving for vacation and wish to pause your membership, it can be paused for up to 7 days and we must have a two-week written notice for account pauses so we can prepare for that month’s business expenses.

If you wish to cancel your membership, please contact your trainer and they will assist you. 

All memberships have a 3-month commitment then your payments will be month to month.

Cancellation/Reschedule/Late Policy

Please note that once you have booked your private or group personal training sessions with us it means that we have reserved time exclusively for you. If you wish to cancel or reschedule a session, please do so inside of the Fulton Fit Academy app at least 12-hours before your scheduled session. We ask for you to provide a 10-hour time frame so that this spot can be filled by another client if they so desire. Each client will receive 1 pass after this the session may not be made up for clients who cancel with less than 10-hours’ notice.  We are human and we do understand that things happen. Under extenuating circumstances (car accident, called into work, illness of yourself or family member) please message your trainer inside the Fulton Fit Academy app to reschedule this session if needed.

If a trainer misses a session with you, regardless of his or her reason, a sincere apology will be forthcoming immediately. We believe that missing sessions is not acceptable. Your time commitment is something we value. If you were not provided with at least 24-hours notice by the trainer, your session will be immediately rescheduled at your convenience. Additionally, you will be provided with a complimentary session. We have a commitment to serving you! Responsibility goes both ways.

To ensure that your time is maximized please be ready to exercise at the appointed time. Workout times cannot be extended. Any time lost due to client tardiness is considered part of the appointment and is non-refundable. Please contact your trainer if you will be more than five minutes late. Trainers will wait 15 minutes for late arrivals at which time it is their discretion whether to keep the appointment. If the client fails to show up at the scheduled time, that session is forfeited.

If a trainer is 10 minutes late for your session the training session will be extended, and regardless, you will be credited with a complimentary workout. We want your commitment and you have ours!

If you are looking to cancel your membership, we must be given a 30 day notice written by email to so we are able to have a paper trail of this. A 30 day notice must be given for all payment plans (monthly, weekly and bi-weekly).


Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

Governing Law

These Terms shall be governed and construed in accordance with the laws of United States without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.


We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days’ notice prior to any new terms taking effect, but in the case that we need to make immediate changes, we will be sure to provide at least a 24-hour notice. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
